Fifth Element Pottery – Pottery Class and Studio Liability Waiver
Acknowledgment of Risks: I, the undersigned, acknowledge that participating in pottery classes and studio activities at Fifth Element Pottery involves certain inherent risks, including but not limited to equipment use, handling of materials, and physical exertion. I understand these risks may result in personal injury or property damage.
Release of Liability: To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Fifth Element Pottery, its officers, employees, teachers, and agents from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activities, or while in, on, or upon the premises where the activities are being conducted.
Indemnification: I agree to indemnify and hold harmless Fifth Element Pottery from any loss, liability, damage, or costs, including court costs and attorneys’ fees, that Fifth Element Pottery may incur due to my participation in said activities, whether caused by the negligence of Fifth Element Pottery or otherwise.
Medical Acknowledgment: I represent that I am physically fit to participate in pottery classes and studio activities and have no medical condition that would prevent my safe participation. In the event of a medical emergency, Fifth Element Pottery may secure emergency medical care for me at my own expense.
Understanding & Acceptance: I acknowledge that I have read this waiver of liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
Firings
The studio undertakes to fire pieces made during classes as quickly as possible. However, ceramics is a slow process, and certain stages cannot be rushed: drying times must be respected, and the kiln must be fully loaded before it can be fired. In addition, the studio also carries out its own production work, and as firings must be shared, this may slow down the overall schedule.
Cancellation or rescheduling
Cancellation possible within 48 hours of booking. 50% refundable up to two weeks before the start of the course. After that, the full course fee is due. No exceptions will be made.
Storage
The studio has a number of shelves but space remains limited. For this reason, unfinished greenware is kept for a maximum of one month. Fired pieces, whether bisque-fired or glazed, are stored for three months after notification of firing. You may collect your pieces during class hours. After these timeframes, items will no longer be retrievable, and the studio reserves the right to recycle or donate them.
Results
The studio undertakes to support you as effectively as possible in developing the skills needed to complete your pieces. However, ceramics can be unpredictable, and even experienced potters encounter occasional failures. The studio therefore accepts no responsibility for breakages related to the making process (drying, glazing, firing), or for any unsatisfactory or disappointing final results.
